論我國的反訴制度
摘 要
反訴制度是民事訴訟法中1項(xiàng)重要的訴訟制度，國外很多國家的民事訴訟立法對(duì)此都做了相關(guān)的規(guī)定。我國民事訴訟法也在1些條文中對(duì)反訴制度作了規(guī)定，但條文簡單粗略，過于原則和缺乏可操作性，加上司法實(shí)踐中的恣意化嚴(yán)重，致使反訴制度根本沒有發(fā)揮其真正的功能和價(jià)值。本文通過對(duì)我國現(xiàn)有反訴制度現(xiàn)狀的研究與分析，在對(duì)兩大法系國家反訴制度進(jìn)行比較的基礎(chǔ)上，試圖從立法、司法等方面進(jìn)行改革，以達(dá)到完善我國反訴制度的目的。

ABSTRACT
As an important system in civil action, counterclaim system has been prescribed by modern legal states in Civil Procedure Law. Civil Procedure Law of China prescribes properly system. But it is too simple to be operated properly, and counterclaim is often disposed of too freely at well in judicial practice .The function of counterclaim is impeded and can not operate very well. This treatise states the present situation of Chinese Counterclaim System and analyses the causes of that ,on the basis of the comparison of the counterclaim system in the two families of law, and it tries to reform on legislation and judicature ,in order to prefect the purpose of Chinese Counterclaim System.
